Strong likelihood. Especially if they have no video for context to base it off.
I thought I read there was a video, but not sure. Either way I think he gets a 6 game suspension. Seems to be the minimum penalty for domestic abuse matters.

After Sunday, the sooner Jacobs gets back, the better.

Do you know if there have been less than 6 game suspensions on similar charges. Again, not sure.

I'm very curious as to the League's approach from here on out.

As has been discussed the CBA mandates a "baseline" 6 game suspension for domestic incidents. Yes it's true that WI law does not consider this a domestic charge but the language used by the League pretty clearly puts it in that category (any violence in the context of a dating relationship)

But the big x-factor has been and remains the mysterious and elusive video footage... There is a lot of chatter about how damning it allegedly looks, but I'm not sure there is really anyone who can say that with any actual confidence. IF it is as bad as some are alleging, then the League may still have motivation to keep Jacobs sidelined until said video gets released. As has been discussed they desperately do not want another Ray Rice situation where they hand out a light punishment before video drops.

BUT, as far as I understand it, the only video comes from Jacobs' own personal security system. Now I would think that Jacobs and his counsel would be very, very much interested in tightly controlling access to said footage. I have to assume they are not out there making copies of his security system's logs/storage and handing those out to PD, Brown County DA, TMZ, etc. I guess there is always the possibility that some 3rd party is involved, gets ahold of a copy and is able to leak it (for instance if he has security that has cloud storage or through something like Ring, Simply Safe, etc), or maybe someone just surreptitiously takes a recording on their phone of the video as they view it, but outside of that - now that the court case is more or less resolved - Jacobs and his camp have no incentive to release any footage, obviously.

Unless there is some kind of leak somewhere OR they are not 100% certain that they have controlled all access to the footage - then it may be the case that the video footage just gets destroyed and forgotten and that's that. In that case you may expect Jacobs back sooner than later. But until that "loose end" (that sounds flippant and I don't mean it to be) is tied up you'd think the league is going to tread pretty lightly still
You’re not being flippant, just speculating.

I’m not aware of the league handing out at least 6 game suspensions, video or not. He pleaded no contest which doesn’t quite mean guilty, just that there is enough evidence for a guilty verdict.

After Sunday, and not down playing the seriousness of the matter, the sooner he comes back the better.

Obviously there’s an incident that happened that’s not favorable for either party. My hope is was this was more of a shove and led to her falling down. With a heated argument that is more understandable. Quay should stand trial! J/K

Now other NFL incidents in the past they were actually knockout punches to the head. Imo this doesn’t appear to be that severe. That Elevator incident was another level of abusive imo.

I think my guess is Josh will get 4-6 Weeks suspension just because the NFL will feel pressure. I doubt it’s less than 3 weeks or more than 6 weeks
Agreed

Josh pled no contest, which means he's accepting that he made a mistake but not saying he committed a crime. It happens quite often in this time of case. As far as the NFL, they'll treat it as an admission of guilt of the specific charges and suspend him accordingly.
Well said and I think it will be 6 games. The league would err to a stiffer penalty, I think….

Someday I am sure that Josh will do a sit down interview and tell his side of the story. But that may be several years from now.
I’m not sure why he’d do that, and he’ll probably be ordered to not discuss it.

Alvin Kamara three game suspension case is the most similar as no domestic violence charge, no contest plea…

The difference essentially is why Kamara incident involved insanely higher violence against someone (based on all we know of Jacobs case)…but Jacobs case the victim was a woman.

I don’t see higher than three games personally.
Interesting the Kamara got 3 weeks. Maybe that will be it.

The NFL could also play hardball. "Produce the video or you remain on the exempt list." or "Absent video to the contrary, 6 weeks."

The video is sealed, but it was sealed at Jacbos' request. And it's video from his system.

That's more along my line of thinking. And I mean, it's basically the league's prerogative - there's no mechanism to "force" a player off the commissioner's list and they don't have any reason to rush things along. They have no incentive to NOT err on the side of extreme caution, given how these incidents have reflected on them in the past... from the league's perspective there's really no downside to forcing him to wait and/or produce his video

Makes total sense if what’s being reported is true … that she was the agressor pursuing him hitting him with a pool cue and she hit her head when he wrested it from her… could be BS but if true A) he should be suiting up next week (if Rodger had any balls… which we know he doesn’t), B) Jacobs new nickname is “8-ball”… C) have Robert Kraft give him the names and numbers of a few good hookers that will keep their mouths shut and lets move on..

 That is LOL funny milani. And of course you are spot on. There is a saying, don't know who said it:

A good reminder to fact-check everything as best you can and to take things with a grain of salt until official confirmation...

Just today alone I've seen two posts going viral and making the rounds.

One of them is claiming that the reason "ANM" wants the evidence sealed is because it contains evidence of her hitting him "10-20 times" with a pool cue.

Meanwhile another is alleging that Jacobs' camp is who wants it sealed and the NFL is insisting they turn it over because "sources close" claim it is "worse" than the Ray Rice tape.

IMO neither of these really pass the smell test. If the footage clearly shows JACOBS being assaulted he would almost surely put up more of a fight than he has. And if the footage is "worse than Ray Rice" it doesn't make any sense that his initial charges got seriously downgraded to just a pair of misdemeanors.

So, who knows what really went down, but like I said...just check sources :p

I'm still thinking on this (probably for no good reason but it's a slow work day)....we DO have confirmation that ANM's camp did officially ask for the video to be sealed, there's no dispute there. As for the "why," the two most sensible reasons that come to mind for me are....

1.) The video paints the situation in such a light that makes it look more like self-defense on the part of Jacobs and/or reflects more negatively on ANM than not having video at all would... and in this situation Jacobs just opted to take the punishment and be done with it

2.) Jacobs or his representatives came to a private settlement with ANM and part of their agreement was that she formally request the video be sealed, that way the league cannot pressure him to turn it over

I will also say something else to consider is that while YES - Jacobs does certainly have the means to fight those charges tooth and nail - and a no contest plea is effectively accepting punishment as though guilty (as I said before, it's not claiming 'not guilty' but it's also not saying you're innocent), Jacobs and other athletes are in a somewhat unique situation in that their means of wealth is extremely time-limited. While a "typical" rich person - someone with the same degree of wealth as Jacobs - would certainly have the resources to maintain a long legal fight, athletes have a very limited income-earning window. It's not uncommon to see the legal process take YEARS to play out.

no contest… pay the $1,000 outta your pocket on the way out the door. Now… is the video (or some of it? ) on his security system? If so I would think it’s his to release. I’m no legal expert but after the proceedings are over/final wouldn’t any “evidence” revert to the oringinal “owner”? Jacobs? Homeowner/condo association??

True. Hard to tell. I know JJ would like to be on the field sooner than later. If he fought this it may take a year or two to get back on it.

Did Jacobs get her pregnant? This is getting weirder by the minute.

I wonder what they’d name their $baby$?

Well said Magooch. I can understand why the victim would want to seal the videos. Once released, even if it's just to the NFL, it will be all over the internet. Neither Jacobs or the victim would want that.

It's a sad situation and I mostly feel bad for the victim. Sounds like a domestic argument that went too far. It seems settled by the parties involved and the courts. That should be good enough for the NFL and the rest of us. Time to move on.

Okay. Based on my experience, as a police officer, and having been involved in several incidents at least similar to this nature, these situations aren't usually one-sided. In the vast majority of cases there's much more to it than what the charges are. As an example, a woman can scratch a man, try to tear his eyes out, knee him in the groin, and hit him with a frying pan before he does anything, and if he reacts by smacking her or knocking her down, he's going to end up being the first one charged with anything because it's automatically assumed that the man is bigger and stronger and should have been able to stop this from happening. The problem is, an enraged woman can be almost impossible to corral under the right circumstances, and often, they're drunk when the event happens.

I had an incident as a police officer where we were called to an elderly couple's home because the daughter had come in and became abusive towards her father who had a very serious heart condition. His wife smacked her daughter on the face during the ensuing argument when the girl wouldn't leave the home. When I got there, with a partner, I realized immediately the girl was drunk and out of control. We tried to remove her from the house, but she refused. Knowing of the man's heart condition, I suggested the man and his wife go into the next room while we resolved the issue. When they turned and were walking away, she tried to force her way past my partner, so I took "remedial action" by throwing a right cross that hit her on the side of the face, knocking her cold. My partner was stunned of course. When she quit talking the elderly couple turned around and saw her hitting the floor. When the woman asked; "What happened," I simply said that she had passed out. She was a big girl, close to 200#, so we ended up dragging her out of the home and to the squad car.

Later, the elderly couple refused to press charges against her own mother. I had no choice but to draw up the papers for it but I also drew up another set that included assaulting a police officer, making life threatening remarks to her father, and for home invasion. I knew the assault could be won and that was it, but it was iffy. So, in the end, because I had to draw up the papers against her mother, the girl recanted her sworn statement. Still, because the charges had been made and it had to go before a judge. The mother pled no contest, got a $50 fine, suspended, 7 days probation, and issued a restraining order against the girl if she should ever enter their home again, or come within 100 yards of her parents.

I realize this isn't exactly the same thing, but all that the public ever knew is that charges were filed against the woman, she pled no contest and had a suspended fine and probation. The facts surrounding the case were never given to the public. Always remember, what you see released as public information is rarely more than the tip of the iceberg as to what actually transpired.

Not a tale, actually happened. Fortunately, she was so drunk she didn't understand what happened. When she woke up, the side of her jaw and face hurt and she asked what happened. We told her she passed out and fell down. She bought it. I could have been facing disciplinary actions if she recalled what happened. I wouldn't have asked my partner to cover for me. We need to live with our actions, but I would have countered with her assault against my partner which he could have verified.

Based on the fact that I was concerned that her actions would cause her father to have a fatal heart attack, and reacted to that and the assault, about the worst I would have gotten would be a written reprimand put in my jacket. It was obvious she was not going to leave willingly, therefore forcing me to take action.

Jacobs' court appearance can be watched here.

Some notes that may be worth keeping in mind relating to this topic/discussion:

- Under oath, Jacobs confirms that the police report was accurate as filed (he affirms that the "information contained in the probable cause section of the criminal complaint" is "true and correct"

- again under oath, Jacobs agrees that "the state could prove the elements of battery and of criminal damage to property beyond a reasonable doubt to 12 people who would all agree that you are guilty as charged of these offenses"

- the judge does acknowledge that the only reason it was not given a domestic violence modifier is because of the state's statutory definition of domestic violence - if they had been living together it would've been given domestic violence modifier.

- the criminal damage to property charge was given a deferred judgment, meaning it will be removed with good behavior. The battery charge however IS permanent and will remain on his record.

- the judge noted that Jacobs' conduct went "far beyond a disagreement or dispute....our legislature believes the system needs to get involved and address the behaviors that you engage in". The Judge also suggested that Jacobs "used his physical size during a disturbance, resulting in the victim being injured" and called it "serious and concerning"

- Jacobs and his counsel do not make any claims relating to self-defense, "mutual combat," or any form of counter-narrative

- Jacobs ultimately states that he "fully understands the seriousness of the situation and takes full responsibility"

NOT A LAWYER, but in my limited understanding much of this seems to clear the minimum bar for a no contest plea. Typically it seems to me that the judge will basically ask if there is enough evidence to convict, or if the court can use the complaint as a factual basis. The "true and correct" attestation regarding the initial complaint goes far beyond that minimum bar; Jacobs is essentially swearing under oath that the police narrative of the incident is indeed what actually happened.

Now again, maybe there is more to the story, but whatever "more" there is it seems readily apparent that Jacobs and co do not believe there to be enough extenuating circumstances to merit the court proceedings to potentially clear his name. Of course there is still the matter of the mystery videotape and Jacobs' league suspension to consider, but long story short I think this it's best practice to keep the actual on-the-record facts in mind when discussing this case
